Terms of Use

Effective date: May 28, 2026

These Terms of Use (“Terms”) form an agreement between you and Josef Richter (“the Developer”) governing your use of the HabitPass mobile application (“the App”). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

License

The Developer grants you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, subject to the Apple Media Services Terms and these Terms.

Subscriptions

How subscriptions work

The App offers auto-renewing monthly and annual subscriptions (“Pro Subscriptions”) that unlock the full feature set after the free portion (if any) ends.

  • Free trial (when offered): no payment is due during the trial. If you do not cancel before the trial ends, your subscription auto-renews and you will be charged the price shown in the paywall.
  • Payment: charged to your Apple ID at confirmation of purchase or at the end of the free trial.
  • Auto-renewal: subscriptions renew automatically at the end of each billing period (monthly or annual) at the same price unless you cancel at least 24 hours before the renewal date.
  • Cancellation: manage and cancel your subscription in the App Store under Settings → Apple ID → Subscriptions. Deleting the App does not cancel your subscription.

Pricing

Current prices are shown in the paywall before purchase. Prices may vary by country and may change with advance notice via the App Store.

Refunds

Refund requests are handled by Apple. Submit requests at reportaproblem.apple.com.

Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the App except to the extent permitted by law.
  • Use the App to harm yourself or others, including by configuring the App to block emergency or safety-critical apps.
  • Circumvent any technical limitations or access controls in the App.
  • Use the App in violation of any law or third-party right.

Screen Time and lock behavior

The App uses Apple’s Family Controls framework to restrict access to apps you choose. You are solely responsible for the apps you choose to block and for the consequences of any restriction. The Developer is not responsible for missed communications, alerts, or any other outcome resulting from blocked apps.

The App’s “skip” feature lets you unlock blocked apps for a day without completing the flashcard exercise. The lock will resume on the next cycle.

No warranty

The App is provided “as is” and “as available” without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, or that any specific learning outcome will be achieved.

Limitation of liability

To the maximum extent permitted by law, the Developer’s total liability arising out of or related to the App is limited to the amount you paid in subscription fees in the twelve (12) months preceding the event giving rise to the claim, or USD $50, whichever is greater. The Developer is not liable for indirect, incidental, consequential, special, or punitive damages.

Third-party services

The App relies on third-party services including Apple Family Controls, RevenueCat (subscription management), and PostHog (product analytics). Your use of these services is governed by the respective third-party terms; the Developer is not responsible for their availability or behavior.

Apple terms

These Terms are between you and the Developer, not Apple. Apple is not responsible for the App or its content. In the event of conflict with the Apple Media Services Terms, the Apple terms prevail with respect to your use of the App Store.

You acknowledge that Apple is a third-party beneficiary of these Terms and may enforce them against you.

Termination

The Developer may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time by uninstalling it. Subscription cancellation is managed via the App Store as described above.

Changes

The Developer may update these Terms. Updated Terms take effect on the date shown at the top of this document. Continued use of the App after updates constitutes acceptance.

Governing law

These Terms are governed by the laws of the jurisdiction in which the Developer resides, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.
